This Commercial Licensing Agreement (the "Agreement") is entered into between Gazzaladra (the "Licensor"), and the Licensee (hereinafter referred to as "You" or "Your"). This Agreement governs the licensing of 3D printing models created by Gazzaladra and shared on Thangs.com/gazzaladra and Patreon.com/gazzaladra , collectively referred to as the “Gazzaladra” designs. By purchasing the “Merchant" or “Seller” tier subscription, You agree to be bound by the terms and conditions of this Agreement.
1.1. Commercial Rights: The Licensor hereby grants You a non-exclusive, revocable, and non-transferable license to sell physical 3D prints of the Gazzaladra designs, under the following conditions:
1.2. Quantity Limit: Commercial license covers all original works, there are no model limits on the quantity of models covered under the license.
1.3. Print Limit: There are no print limits on the quantity of prints covered under the licence.
1.4. Attribution: Every listing of the Design must contain the credits “Design by Gazzaladra” , include a link to the Gazzaladra wonderlink website: https://wonderl.ink/@gazzaladra .
1.5. Original concepts: Only my original works of art are covered in this commercial license. (Commercial licensing may not be applied to fan art or derivatives.)
2.1. Quality Assurance: You are solely responsible for the safety and quality of the 3D prints you sell. The Licensor shall not be liable for any defects, injuries, or disputes arising from the use or sale of the printed items.
2.2. Dispute Resolution: You agree to handle and resolve any disputes that may occur between you and your customers regarding the 3D printed items. The Licensor shall not be responsible for any such disputes.
2.3. Photography: You must always take your own photos and videos. Using the photos and videos made by Gazzaladra in any way is not permitted. You may not alter your own photos or videos of Gazzaladra designs with artificial intelligence. You may not use any representation of Gazzaladra designs that are created or altered with artificial intelligence to advertise your 3D prints.
2.4. Fan art: Fan art models are prohibited from commercial licensing and all sales. The seller of any fan art assumes sole responsibility of sales and any legal recourse.
3.1. Manufacturing: This license applies only to the 3D Printing method of manufacture. These files may not be used to make injection molded parts, or be produced with any other mass-manufacturing method other than 3D printing.
3.2. Outsourcing: This license only covers selling physical 3D prints of the gazzaladra designs that you manufactured yourself. You may not outsource the manufacturing to any third party.
3.3 Platforms: This license forbids the usage within a platform that allows users to upload their own digital files to facilitate the production and distribution of physical 3D prints including print-on-demand services. This covers the user, owner and any subsidiary or otherwise involved party. This does NOT include third party websites like Etsy.com that do not require the upload of the digital file.
